    letter from Marlin debt agency
    Mar 13th, 2008, 5:00pm   Hi to everyone!
    I had a car on hire purchase in Feb 2002 which i defaulted on due to being unemployed, sometime later about 1 year the car was repossed.
    Anyway i ignored demands for any money and never acknoleged the debt.
    I have checked my credit report and it states that the debt is satisfied.
    Obviously a debt collection agency bought the debt.
    I have been getting letters form a company called Marlin with all kinds of threataning actions against me.
    The latest letter says they are rcomending the creditor makes me bankrupt.
    I am currently living at my mothers with my partner and not on the electorol roll there.
    What are the chances of them actualy making me bankrupt?
    I have totaly ignored their letters e.t.c as the debt was taken out 6 years ago.
    Has anyone got any advise?

    Reply #1 - Mar 13th, 2008, 8:57pm   When exactly was the last time you had contact with the loan company, or is there a date on your credit file stating when the loan was filed as 'satisfied' ?

    Reply #5 - Yesterday at 12:44am   Yes agree sue.. Ok it says satisfied 2006 so that could be the time it was sold on or put somewhere for the time being or what ever.. My opinion is send skis letter to marlin to see what info they hold as its bordering on the 6 year stat.. Could we not ask for a sar ?

    Reply #6 - Yesterday at 11:42am   A sarn would show all the info and possibly any last payment dates but it's highly likely though that marlin have bought the debt & dont hold the payment details.  If they did it could tip their hands.  If for instance there was 3 months to go Marlin might notice and get the CCJ process underway earlier than they normally would.    
     
    I'd be more inclined at this point to sarn my bank if I knew the last payment was dd or cheque and didnt have the statements.  The prove it letter to marlin would give a month or more breathing room while they scrabble to get the copy and possibly a deed of assignment.

    Reply #8 - Yesterday at 1:51pm   If it came to it, say they were going to take me court to make me BR, could i send them a prove it letter or say the debt was in dispute, as the money they are asking for (6000) is the money that was owing at the start of the agreement.
    I did pay a number of payments at 173( the original company was first response) and the car was taken back but they say i owe the whole lot, is this correct?
    Would it be possible to make an offer of instalments if i had too, i dont want to go BR as i have built up my credit rating again(a bit) and the prospect scares me.

    Could they serve BR papers on me even if they dont personally give me a letter.
    If anyone came knocking at the door my mother or partner would say i dont live here.
    Also say i get another letter(i can tell by the envelope, but no address on) is it possible to just send the letter back saying `person not at this address` how is the best way to do this as the letter would have to be opened to get the address.

    Reply #10 - Yesterday at 4:29pm   Point 1. Its highly unlikely they would make you br. Point 2. If they knocked at your door tell them to 'get of your property or you will call the police' . Right you have to cover yourself best you can here and send the prove it letter.. Get that done now and find out when the last time you spoke/paid them was. If they take you to court that will be dealt with later but for now just send the letter and try some yoga dmq
