    First Credit
    Jun 12th, 2008, 7:52pm   Hi I'm new here, have been lurking for a bit reading advice etc. I need some help please with first credit. They are threatening me with allsorts, even bankrupcy!!. They have bought a debt of mine for 3000. Its a credit card debt from 2003. I have tried to offer them payments but they wont agree, saying I can pay more when I cant.
     
    What should I do?

    And where in the UK are you? England or Scotland!?

    Reply #4 - Jun 13th, 2008, 9:08am   Hi Bing, the last payment was 2006. September I think. Since then (I was paying 50 per month) my circumstances have changed. I wrote and told them about the change and offered 5 per month and my new budget sheet but they would not even consider this and are now really putting pressure on me to pay 100 per month or they say they will make me bankrupt. I have been sending them 5 anyway. I do have one other debt, from a visa card for 2600 but thats with another dca and thay have been accepting 5 per month since 2006 so if they can why cant First credit? Will they bankrupt me? I am in england.

    Reply #5 - Jun 13th, 2008, 12:02pm   There is always a chance that they could make you bankrupt but it's so remote it's a joke.  Would cost them approx 1500 with next to no chance of getting that back let alone anything else.   Just yet another scare tactic from a bunch of bullies.
     
    I would be inclined to send them the prove it letter and hope that they dont have the correct paperwork.  Send the letter & stop paying them until they do send the paperwork.    
     
    If you could get your total debts to below 5k and have a ccj it would be possible to get an admin order from the court.  Not worth going into if your debt is above 5k so please check the exact figures, just in case.

    Still having hassle with first credit. Have been making nominal payment of 10 per month but as before they want more or the usuall threts. Its wearing me down and I dont know what to do. Should I just let them take me to court?

    Whatever you do, DO NOT NOT NOT NOT NOT NOT give them a contact number, insist on dealing with this in writing, that way you have a record of everything they are doing.
     
    Have you been to the CAB about this?  What would the impact be for you if they did try and make you BR?  Is this your only debt?  Sorry for all the questions, it might be best for you to look at the newcomers thread (sorry if you have already gone into this,!!) and post the info on here for the pro's to have a look at.
     
    I'm not an expert but I'm sure someone will have some sound advice for you.

    I know this is a worrying time but the bottom line is, if you haven't got the money, they can't have it!  As already mentioned, don't whatever you do give them a contact telephone number.  Call their bluff and let them take you to court - any judge would see this is all you can afford. You'd get a CCJ but that might be used to your advantage (see above post) for debts of 5K and below.
     
    Have you spoken to anyone about this - i.e. CAB/National Debtline etc?  You might feel better having someone working on your behalf.
     
    Do you see your situation getting any better in the future? Are both these creditors adding on interest and therefore increasing the size of the loans?

    Reply #10 - Aug 6th, 2008, 9:15pm   1st credit are full of it.  If they continue to threaten, write to them and say continued threats will be seen as harrassment and you will report them to the office of fair trading.
    They can't take what you don't have and even if they take you to court, the court will not order you to pay what you can't afford.
     
    Stick to your guns and don't let them frighten you.  There's plenty of support here.  You can also call the national debt help line and get advice from them.

    Reply #11 - Aug 7th, 2008, 7:33pm   Either send the prove it letter as already suggested.. or post your I&E on here.. it could be that you have put things on it that NO creeditor would accept.. I can glance my eye over it.. tell you what and where to amend and then how to deal with any further letters..
