    A debt I dont owe! HELP Please!
    Aug 9th, 2008, 11:34am   A bit of a complex problem.
     
    In 2004 i moved to New York, i had zero debt but had a Egg credit card and a Orange mobile phone. Both were under the limits and paid on time. 3 weeks after arriving in New York someone got into my hotel room and found my egg card hidden (it was my emergency one) and my orange phone (my english mobile). They ran up the limits on the phone and egg card, I did not notice they had gone for a few days.
     
    However I claimed on my insurance and the orange was paid off as well as the egg. It did take a couple of months to sort this out. Egg and Orange at the time were fine with me about this. As far as I was concerned that was the end of the matter.
     
    In 2007 i returned to the UK, and tried to settle down again. I obtained my credit files a few weeks ago to find that orange had filed a default and the account was still open and now owing 800 odd pounds. No debt agency was chasing me.
     
    My Egg card was showing 4000 outstanding and had a default, but then the following month showed as settled. However next to it was debt collection agency acting for Egg now claiming that I owed the money. It also seems on my credit file they have duplicated the debt again, so it looks like I have 12k outstanding on the egg card when in fact I only have 4k and so its showing 1 default for each of these all issued on the same month!
     
    No one is chasing me for the Orange, buts its not listed as settled and they issued a default even though it was paid off by the insurance company (although it did take them some time to sort out)
     
    I have had a couple of letters to my new address from the debt company chasing the Egg debt, what was interesting was the first letter was offering me to pay 3k to settle the account. Seems to me they know what they have done and trying it on. I have not contacted them yet. I was in debt like 10 years ago and I know how evil these people can be.
     
    Also when I came back from New York I was staying at my sisters and some how the debt collection company have me at this address (showing as linked address) in my credit file.
     
    My Experian credit files are clean and NOT showing this, but my equifax is showing the above problem.
     
    Does anynoe have a list of companies that only check Experian and not Equifax for getting credit cards / loans etc? I need a credit card now I am back and also trying to get a car lease which is why I even started looking into all of this. I got turned down and was trying to find out why.
     
    My questions
     
    1. I understand you cannot get a default removed, it was issued in 2004 so I am now 4 years into the default. Only 2 years for it to drop off. If I contact the debt companies does the clock start again? What I am worried about is if I go fight this I just end up shooting myself in the foot, by trying to prove that Egg should never have sold the debt in the first place let alone issued me with a default. The debt company will not care, and so chase me and then start the default time all over again and make me pay the money back.
     
    2. I assume there is nothing I can do that for one debt of 4k its showing as 12k with 3 defaults! How can that be fair. I assume from a bank etc they do not see the difference? Or is this quite normal?
     
    Its also so long ago, I don't think I have any prove that the insurance company paid it off. Most of that paperwork I ditched when left New York - did not occur to me that I might need it.
     
    2. Could i just get the linked address removed from my credit file, I never lived there. That would remove from my credit file? But I am not sure if thats a bit naughty! I don't mid being a "naughty" they never play by the rules so why should I
     
    3. I know in theory I could fight this, however I can see the debt company going - its not out problem Egg sold us a loan. Egg will say, they have nothing to do with it as it was settled.
     
    4. The other option is I wait until 2010 when it drops off anyway, the question is can I hold off the debt company from finding me for 2 years.
     
    Seems to me I have been totally screwed over and without opening a can of worms I cannot fix the problem either.
     
    UPDATE: Sorry, one more question.  If I add a notice of connection explaining this - would the debt company also see the next time they do a check.  Wondering if that would be one way to help out in the sort term, or do companies just igmore notice of corrections?

    Reply #1 - Aug 9th, 2008, 6:28pm   Hi.  What a horrid thing to happen.  Do you know for sure that the insurance companies settled the debts in full - do you have any of the correspondence from either creditor or insurance company?
     
    I would personally tackle this head on (afterall you've done nothing wrong) and contact both creditors for this to be rectified.  It is their responsbility to correct the errors they've made. If you leave it, it'll probably come back and haunt you and as it's their error, I'd get them to check it quickly as possible.  Go back to original creditors (in writing by recorded delivery) and do not enter into conversations with any DCA.
     
    Wait for the professionals too but this is what I'd do given the information provided.
